Terms of Service

These Terms are a binding agreement between the adult account holder and Helix Media LLC, the operator of Color It Up. By creating an account, using the service, buying points or a membership, or submitting content, you agree to these Terms and our Privacy Policy.

If you do not agree, do not create an account or use the service. Color It Up is offered for users in the United States.

• Account holders must be at least 18 years old and give accurate information.
• An account is for one household. It may not be sold, transferred, or shared outside the household.
• Protect your password, sign-in provider, devices, and parent PIN. You are responsible for activity in your account.
• Tell us promptly at support@color-it-up.com if you think your account is being used without your permission.

• A child may use Color It Up only under the supervision of a parent or legal guardian, through that adult’s account, on a device the adult has locked to Kids Studio with Kids Only Mode.
• Kids Only Mode applies only to the device where you turn it on, and each browser or app on a device is locked separately. A device, browser, or app that isn’t locked gives full access to your account, including Adult Studio, purchases, and settings. Lock every browser or app a child can open (or sign out of the others), don’t let a child use anything that isn’t locked, and don’t share your PIN or password with a child. While a device is locked, any new sign-in to your account starts in Kids Only Mode and stays there, even after that device is unlocked, until you unlock it there (with the PIN or an emailed unlock) or turn Kids Only Mode off on every device.
• A locked device unlocks with the parent PIN on that device, or with an emailed link that you open and confirm. Only confirm unlock requests you made. You can turn Kids Only Mode off on every device from Account & Family → Studios & family.
• Photo uploads, AI sketches, Magic Words, and 3D Magic send a child’s content to our AI provider, so they stay off in Kids Only Mode until you turn each one on. Before you can, we confirm you are a parent with a card payment on the account or a $0.50 card check that we refund right away, as described in the Privacy Policy.
• You decide which features your child may use and are responsible for what is submitted from your account. Kids Only Mode and our safety filters reduce risk but do not replace supervision.

Color It Up provides tools that turn words, sketches, photos, and artwork into coloring pages, editable vector line art, colored versions, and 3D-style images, along with private project storage, family controls, points, memberships, downloads, and moderated community sharing.

We may improve, add, limit, suspend, or discontinue features. We will make reasonable efforts to give notice when a material change affects a paid membership.

As between you and Helix Media LLC, you keep the rights you have in your prompts, uploads, drawings, coloring, and project content. You give us a nonexclusive, worldwide, royalty-free license to host, copy, process, transform, transmit, display, and make technical derivatives of that content only as reasonably needed to operate, secure, and support Color It Up. We do not use your content, or your child’s, to train AI models.

If you submit a project for community publication, you also give us a nonexclusive, worldwide, royalty-free license to review, moderate, reproduce, display, distribute, and promote that submission in connection with Color It Up. You may ask us to stop displaying it.

You promise that:

• you own the content or have every permission needed to provide it;
• the content does not violate anyone’s copyright, privacy, publicity, or other rights;
• you have a parent’s or guardian’s authority before uploading an identifying image of a minor; and
• your content and instructions follow these Terms and the law.

Color It Up uses automated systems, including OpenAI services, to make and transform content. AI results may be unexpected, inaccurate, incomplete, similar to content made for others, or unsuitable for a particular use. Review results before printing, publishing, selling, or relying on them.

We do not guarantee that an AI output is unique, copyrightable, free of third-party rights, or fit for commercial use. You decide whether and how to use an output. Safety filters may reject or change requests, and we may block content that appears unsafe or unlawful.

You may not use Color It Up to:

• break the law, facilitate harm, or violate another person’s rights;
• upload or create child sexual abuse material or sexualized content involving minors;
• create exploitative, abusive, threatening, hateful, or dangerously deceptive content;
• impersonate another person or upload someone’s private content without permission;
• get around safety filters, parental controls, Kids Only Mode, rate limits, billing, access controls, or moderation;
• introduce malware, scrape the service, reverse engineer protected systems, or interfere with its operation;
• resell account access, points, memberships, or AI generation without written permission; or
• train or benchmark competing models through automated extraction without written permission.

We may remove content, restrict features, suspend accounts, preserve evidence, or report suspected illegal material when reasonably necessary.

Projects are private unless an adult intentionally submits them for sharing. Submitting does not guarantee publication. We may use automated and human moderation and may approve, reject, hide, or remove a project for safety, quality, privacy, or legal reasons.

Only an adult account holder may submit content, and only Adult Studio projects are eligible. Kids Studio projects cannot be submitted. A community for children will not launch under these Terms.

• Points are a limited license to use features that cost points. They have no cash value, can’t be sold or transferred, and can’t be exchanged for money except where the law requires. The cost of each creation is shown before you start, and points for a creation that fails are returned automatically.
• A new account starts with 15 points. Points from one-time packs and starting points do not expire, and neither do points we add as a courtesy.
• A membership adds a monthly allowance of points and renews automatically each month until you cancel. You authorize our payment processor, Stripe, to charge your payment method at each renewal.
• Monthly points expire. Points from a month’s allowance that are unused when the next month’s points arrive, or when the membership ends, expire. Monthly points are used before other points, so expiry takes only monthly points. A refund or chargeback that removes points you had already used works the other way: it takes your pack, starting, and courtesy points before this month’s points, so this month’s unused points can still expire at the next reset.
• You can cancel a membership from your account at any time. Cancelling stops future renewals; the membership stays active until the end of the period you have paid for, and its unused monthly points expire when it ends.
• If we change membership prices, we will tell you before the new price applies to a renewal, and you can cancel before then.

Payments are generally nonrefundable except where the law requires. If something went wrong, email support@color-it-up.com; we will review exceptional cases, but asking does not guarantee a refund. If we permanently discontinue a paid service before the end of a prepaid period, we may give a reasonable credit or refund.

• Refunds remove the points that payment added. A partial refund removes the same share of those points.
• Chargebacks do too. If you dispute a payment with your bank, we remove the points it added. If the dispute is decided in our favor, those points come back.
• Your balance can go below zero. If you already used those points, your balance goes negative. While it is below zero you can’t spend points; the next points you get, from a purchase or a renewal, cover the difference first. We never charge you money for a negative balance.
• Refunding a membership payment does not cancel the membership. Cancel it separately if you want it to stop.
• The $0.50 card check used to confirm a parent is refunded right away. It is not a purchase and adds no points.
• Parent verification can end. If the payment that confirmed you as a parent is charged back, or a points pack or membership payment behind it is refunded, even in part, the confirmation ends and child features in Kids Only Mode turn off until you confirm again.

Please contact us before disputing a charge; we can usually sort it out faster.

Color It Up’s software, branding, interface, prompts, templates, graphics, and service design are owned by Helix Media LLC or its licensors and are protected by law. These Terms give you a limited, personal, nonexclusive, nontransferable, revocable right to use the service as intended.

If you send feedback or suggestions, you allow us to use them without restriction or payment, but we will not publicly name you as the source without permission.

If you believe content on Color It Up infringes your copyright, email privacy@color-it-up.com with the subject “Copyright notice”. Include:

• your physical or electronic signature;
• the copyrighted work you believe is infringed;
• the content you believe infringes it, and where it appears, such as its web address;
• your name, mailing address, phone number, and email address;
• a statement that you believe in good faith the use is not authorized by the copyright owner, its agent, or the law; and
• a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.

If we remove your content after a notice and you believe that was a mistake, you may send a counter-notice to the same address. We may remove disputed content and will end the accounts of repeat infringers where appropriate.

You may stop using Color It Up at any time. You can delete your account in Account & Family → Profile & security. Deletion is immediate and permanent: any membership is cancelled right away, and unused points and the rest of a paid period end without a refund unless the law requires one. The Privacy Policy explains the few records kept afterward, such as Stripe’s payment records.

We may suspend or end access when an account violates these Terms, creates safety or legal risk, fails to pay amounts due, or threatens the service or other users. When practical, we will give notice and a chance to contact us.

Provisions that by their nature should survive, such as content permissions already exercised, payment obligations, disclaimers, liability limits, and dispute terms, remain in effect after an account ends.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLOR IT UP IS PROVIDED “AS IS” AND “AS AVAILABLE.” HELIX MEDIA LLC DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, PERMANENT STORAGE, A PARTICULAR AI RESULT, OR THAT EVERY ERROR OR HARMFUL SUBMISSION WILL BE PREVENTED.

Nothing in these Terms limits rights or warranties that cannot legally be waived.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HELIX MEDIA LLC AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM COLOR IT UP.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO COLOR IT UP DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Helix Media LLC from third-party claims, damages, and reasonable costs arising from your unlawful use of the service, your content, your violation of another person’s rights, or your material breach of these Terms. This does not apply to the extent a claim results from our own unlawful conduct.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Unless applicable law requires otherwise, courts located in Bexar County, Texas will have exclusive jurisdiction over disputes relating to these Terms or Color It Up.

Before filing a claim, please contact us and give both sides 30 days to try to resolve the issue informally. These Terms do not require arbitration and do not waive any nonwaivable consumer right.

We may update these Terms as the service or the law changes. When a change matters, we update the effective date above and ask you to review and accept the new Terms in the app before you continue.
