1. Agreement and operator
These Terms are a binding agreement between the adult account holder and Helix Media LLC, the operator of Color It Up. By creating an account, using the service, purchasing a plan, or submitting content, you agree to these Terms and our Privacy Policy.
If you do not agree, do not create an account or use the service. Color It Up is initially offered for users in the United States.
2. Adult accounts and supervised child use
- Account holders must be at least 18 years old and provide accurate information.
- Accounts are personal and may not be sold, transferred, or shared outside the household.
- You must protect your password, sign-in provider, device access, and parent PIN.
- A child may use age-appropriate coloring features only under the authority and supervision of a parent or legal guardian who controls the account.
- Adults may use either visual studio. When the adult activates Kids Only Mode for a child, protected server-connected features begin disabled and require separate authorization from the signed-in adult account before child use. A paid membership is not required to manage those permissions.
- The adult must control purchases, account settings, publication decisions, and any upload or AI request that may contain personal information.
Notify us promptly if you believe an account is being used without adult authorization or has been compromised.
3. The Color It Up service
Color It Up provides tools that can turn text, sketches, photos, and artwork into coloring pages, editable vector line art, colored variations, and stylized images. Features may include private project storage, family controls, points, subscriptions, downloads, and moderated community sharing.
We may improve, add, limit, suspend, or discontinue features. We will make reasonable efforts to give notice when a material change affects a paid subscription.
4. User content and permissions
As between you and Helix Media LLC, you retain the rights you have in your prompts, uploads, drawings, coloring choices, and project content. You grant us a nonexclusive, worldwide, royalty-free license to host, copy, process, transform, transmit, display, and create technical derivatives of that content only as reasonably needed to operate, secure, improve, and support Color It Up.
If you intentionally submit a project for community publication, you also grant us a nonexclusive, worldwide, royalty-free license to review, moderate, reproduce, display, distribute, and promote that submission in connection with Color It Up. You may request that we remove it from future display.
You represent that:
- you own the content or have all permissions needed to provide it;
- the content does not violate another person's copyright, privacy, publicity, or other rights;
- you have parent or guardian authority before uploading an identifying image of a minor; and
- your content and instructions comply with these Terms and applicable law.
5. AI-generated content
Color It Up uses automated systems, including OpenAI services, to generate and transform content. AI results may be unexpected, inaccurate, incomplete, similar to content generated for others, or unsuitable for a particular use. You must review results before printing, publishing, selling, or relying on them.
We do not guarantee that an AI output is unique, copyrightable, free of third-party rights, or appropriate for commercial use. You are responsible for deciding whether and how to use an output. Safety filters may reject or alter requests, and we may block content that appears unsafe or unlawful.
6. Prohibited conduct and content
You may not use Color It Up to:
- break the law, facilitate harm, or violate another person's rights;
- upload or create child sexual abuse material or sexualized content involving minors;
- create exploitative, abusive, threatening, hateful, or dangerously deceptive content;
- impersonate another person or upload private content without authorization;
- bypass safety filters, parental controls, rate limits, billing, access controls, or moderation;
- introduce malware, scrape the service, reverse engineer protected systems, or interfere with operation;
- resell account access, points, subscriptions, or API-backed generation services without written permission; or
- use the service to train or benchmark competing models through automated extraction without written permission.
We may remove content, restrict features, suspend accounts, preserve evidence, or report suspected illegal material when reasonably necessary.
7. Community submissions
Projects are private unless an adult intentionally submits them for sharing. Submission does not guarantee publication. We may use automated and human moderation and may approve, reject, hide, or remove a project at our discretion for safety, quality, privacy, or legal reasons.
Only an adult account holder may submit content. A future child-focused community will not launch under these Terms without additional age, parental-consent, safety, and moderation protections.
Kids Studio projects are not currently eligible for community submission. Only Adult Studio projects may enter the present moderation queue.
8. Points, subscriptions, and billing
- Points are a limited license to access eligible features. They have no cash value and are not transferable.
- Generation costs and plan allowances may differ by feature and will be shown in the service.
- Unless stated otherwise at checkout, paid subscriptions renew automatically until canceled.
- You authorize our payment processor to charge the payment method associated with the purchase.
- Canceling stops future renewals but generally does not reverse a charge already processed.
Payments are generally nonrefundable except where required by law. You may contact us if exceptional circumstances apply, but contacting us does not guarantee a refund. If we permanently discontinue a paid service before the end of a prepaid period, we may provide a reasonable credit or refund.
9. Intellectual property and feedback
Color It Up's software, branding, interface, prompts, templates, graphics, and service design are owned by Helix Media LLC or its licensors and are protected by law. These Terms give you a limited, personal, nonexclusive, nontransferable, revocable right to use the service as intended.
If you provide feedback or suggestions, you permit us to use them without restriction or payment, but we will not publicly identify you as the source without permission.
10. Copyright and rights complaints
If you believe content in Color It Up infringes your rights, email nathan.hovatter@helixmediafx.com with your contact information, identification of the protected work, the location of the disputed content, a good-faith explanation, and any other information needed to evaluate the request.
We may remove disputed content and terminate repeat infringers where appropriate. This contact process does not replace any formal notice method required by applicable law.
11. Suspension and termination
You may stop using Color It Up or request account deletion at any time. We may suspend or terminate access when an account violates these Terms, creates safety or legal risk, fails to pay amounts due, or threatens the service or other users. When practical, we will provide notice and an opportunity to contact us.
Provisions that by their nature should survive—such as content permissions already exercised, payment obligations, disclaimers, liability limits, and dispute terms—remain effective after termination.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLOR IT UP IS PROVIDED “AS IS” AND “AS AVAILABLE.” HELIX MEDIA LLC DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, PERMANENT STORAGE, A PARTICULAR AI RESULT, OR THAT EVERY ERROR OR HARMFUL SUBMISSION WILL BE PREVENTED.
Nothing in these Terms limits rights or warranties that cannot legally be waived.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HELIX MEDIA LLC AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM COLOR IT UP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO COLOR IT UP DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Helix Media LLC from third-party claims, damages, and reasonable costs arising from your unlawful use of the service, your content, your violation of another person's rights, or your material breach of these Terms. This does not apply to the extent a claim results from our own unlawful conduct.
15. Texas law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Unless applicable law requires otherwise, courts located in Bexar County, Texas will have exclusive jurisdiction over disputes relating to these Terms or Color It Up.
Before filing a claim, please contact us and give both sides 30 days to try to resolve the issue informally. These Terms do not require arbitration and do not waive any nonwaivable consumer right.
16. Changes and contact
We may update these Terms as the service or law changes. We will provide reasonable notice of material changes. Continued use after the effective date of updated Terms constitutes acceptance where permitted by law; when affirmative consent is required, we will request it.
